How to Respond to an FBR Section 122(5A) or Section 114(4) Notice Without Panic

Seeing an automated email or SMS from FBR IRIS stating that a notice has been issued under Section 114(4), Section 122(9) read with 122(5A), Section 161, or Section 177 can be stressful.

However, an FBR notice is not a final tax conviction. Under Pakistani tax law, every statutory notice is an opportunity to place your documented reconciliation and legal explanation on the official record—provided you respond before the due date and never ignore the IRIS inbox task.

1. Understand Which Notice You Received

Before drafting a single line of reply, identify the exact statutory section printed at the top of the notice in your FBR IRIS inbox:

  • Section 114(4) (Notice to File Return): Issued when FBR records show you own a vehicle, bought/sold property, traveled abroad, earned significant bank profit, or hold a commercial connection, but have not filed an income tax return for one or more past tax years.
  • Section 122(9) / 122(5A) (Amendment of Assessment): Issued after you have already filed a return, when the Assessing Officer or automated risk system spots a discrepancy—such as bank credits exceeding declared turnover, un-reconciled property purchases under Section 236K, or an exempt income claim (like foreign remittances or agricultural income) lacking documentary proof.
  • Section 161 / 205 (Monitoring of Withholding Taxes): Issued to businesses or companies asking them to reconcile expense heads in their financial statements (salaries, rent, purchases, services) against the withholding tax they deducted and deposited.

2. Never Let a Notice Expire Unanswered (Avoiding Ex-Parte Orders)

The worst mistake taxpayers make is ignoring an IRIS notice or asking an informal agent who promises to "manage it verbally" at the tax office.

Every IRIS notice carries a strict statutory deadline. If no written reply or adjournment request is submitted inside the IRIS workflow before the hearing date expires, the officer has the power to pass an ex-parte assessment order confirming the entire proposed tax demand—which can lead to bank account attachment under Section 138 or 140 after the appeal window closes.

3. How Our Desk Builds a Defensible Notice Response

When you open a Notice Response Case on Corporate Morning Desk, we follow a disciplined four-step protocol:

  1. Timely Adjournment (If Needed): If gathering bank statements, PRCs, or old property deeds will take time, we immediately file a formal, reasoned adjournment request inside IRIS so your statutory right of hearing stays protected.
  2. Line-by-Line Fact & Bank Reconciliation: We build a clear reconciliation schedule mapping every questioned figure in the notice against your submitted return, bank statements, CPRs, and third-party portal data (Maluoomat).
  3. Documented Evidence Annexures: Every claim (such as an inter-account transfer between your own banks, a formal family gift via cross-cheque, or a foreign remittance PRC) is indexed as a numbered PDF exhibit.
  4. Written Legal & Factual Reply in IRIS: We submit the structured written reply directly inside the IRIS notice task so that even if an officer disagrees on a point of law, your complete documentary record is preserved for the Commissioner (Appeals).
