Overseas Pakistani Property Tax Guide: Filer, Late Filer & Non-Filer Rates (236C / 236K / 7E)
Buying or selling plot files, residential houses, apartments, or commercial property in Pakistan as an Overseas Pakistani (Non-Resident) involves three critical tax provisions at the time of transfer:
- Section 236C: Advance tax on the seller/transferor of immovable property.
- Section 236K: Advance tax on the buyer/transferee of immovable property.
- Section 7E: Tax on deemed income from capital assets (immovable property in Pakistan exceeding the PKR 25 million fair market value threshold), unless an exemption applies.
Understanding how non-resident verification works can save you millions of rupees in excess withholding taxes at the sub-registrar, housing society, or CDA/LDA/DHA transfer office.
1. Active Filer vs. Late Filer vs. Non-Filer Property Tax Slabs
Recent Finance Acts introduced a three-tier structure for advance property tax under Sections 236C (Seller) and 236K (Buyer), tiered by the gross value / FBR valuation of the property (up to PKR 50M, PKR 50M–100M, and above PKR 100M):
- Active Timely Filer: Lowest advance tax rate (starting at 3% depending on value bracket).
- Late Filer: Intermediate rate for taxpayers who filed their most recent return after the statutory deadline.
- Non-Filer: Punitive advance tax rates (ranging from 10% up to 12%+ for buyers, and 10%+ for sellers).
However, bona fide Non-Resident Pakistanis holding a NICOP (National Identity Card for Overseas Pakistanis) or POC (Pakistan Origin Card) have specific statutory protections under the Tenth Schedule and Section 7E when properly verified through FBR IRIS.
2. How the Overseas Pakistani Verification Certificate Works in IRIS
If you live and work abroad (such as in the UAE, Saudi Arabia, UK, USA, Canada, or Europe) and stayed in Pakistan for fewer than 183 days during the tax year, you are a Non-Resident Person under Section 82 of the Income Tax Ordinance.
Instead of paying punitive non-filer rates on a property purchase or sale, an Overseas Pakistani can apply in FBR IRIS for a Non-Resident / Overseas Pakistani Verification Certificate under the Tenth Schedule and Section 7E:
- Passport & Entry/Exit Travel History: We compile your valid NICOP/POC, foreign residence visa/Iqama/permit, and passport entry/exit stamps proving your non-resident day count.
- Property Transaction Details: We attach the sale agreement, FBR/DC valuation calculation, and particulars of the transferring authority (DHA, Bahria, CDA, LDA, or Sub-Registrar).
- Commissioner Verification in IRIS: Once the Commissioner Inland Revenue verifies the application in IRIS, a system-generated certificate with a barcode is issued, allowing the transferring authority to apply filer rates and/or recognize statutory non-resident exemptions.
3. Never Buy Fake "Without Password" 7E Certificates
Because property transfer dates are often tight, street agents near society transfer offices frequently offer "instant 7E certificates without password." These are either forged PDFs or generated by hijacking someone's IRIS account—and societies now verify every barcode online. Always apply through your own IRIS profile at least 5 to 7 working days before your transfer date.
